What we know about California
California runs the state's payroll tax and benefit system through the Employment Development Department (EDD). The 2026 unemployment insurance rate schedule is Schedule F+, which is Schedule F plus a 15 percent emergency surcharge rounded to the nearest tenth, producing contribution rates between 1.5 and 6.2 percent. New employers are assigned a 3.4 percent UI rate for two to three years, and the taxable wage limit is $7,000 per employee per calendar year, a base that has not changed since the federal FUTA limit of 1983. The Employment Training Tax (ETT) adds a further 0.1 percent on the same $7,000 limit.
State Disability Insurance (SDI) is a separate payroll levy. The 2026 SDI withholding rate is 1.3 percent, and effective January 1, 2024, all wages are subject to SDI contributions — the previous wage cap was repealed, so SDI is computed on uncapped earnings. The same SDI system funds Paid Family Leave (PFL), meaning a California employer's SDI remittance doubles as the worker's disability and paid-leave insurance. A PEO paying wages in California must therefore register with the EDD, obtain an employer account number within 15 days of becoming liable, and handle UI, ETT, SDI and PIT withholding across the account structure.
Workers' compensation in California is a competitive market: the State Compensation Insurance Fund (SCIF) competes with private carriers. The Division of Workers' Compensation warns employers that buying coverage through a PEO does not release them from liability; the carrier must hold a certificate of authority from the California Department of Insurance, and the client employer must be listed as an additional insured. If coverage is not valid, the employer faces penalties under Labor Code section 3700, including criminal liability.
There is no general PEO licensing program in California. Pending bill AB 1515 (2026 session) would create a registration regime with the Division of Labor Standards Enforcement, but as of the verification date it had not been enacted, and staffing agency licenses under Labor Code 1682 are a separate temporary-services program, not a PEO registration. For a buyer, client-level treatment means a certified PEO can report UI and pay taxes under each worksite employer's account, keeping the client's own experience record attached to the client rather than pooled on the PEO's history. For the PEO, it means the account structure, the EDD registration, and the 15-day registration clock all have to line up before the first payroll runs, and the uncapped SDI line has to be priced into every quote because the withholding runs on all wages with no ceiling.
