PEOs and 401(k) Retirement Plan Administration

A PEO can administer the day-to-day 401(k), the recordkeeping, the enrollment and the payroll contributions — but it does not become the plan sponsor. The plan is yours, and the fiduciary responsibility that attaches to your employees is not shifted by hiring a PEO.

What the PEO runs

Under an arrangement, the PEO often handles the 401(k) mechanics: the plan's enrollment, the payroll contributions, the recordkeeping vendor and the communications to employees. That is real value, because it removes the daily jangle of retirement admin from your desk.

Who the plan sponsor stays

The eligibility, the match design, and the fiduciary duties that fall to the plan sponsor remain yours. A PEO running the recordkeeping does not make it the sponsor or the fiduciary of your plan — that is a function of who the plan belongs to and who controls it.

The fee question

The 401k offered can be priced into the PEPM or as a separate per-participant fee. Ask which one it is, so you are comparing admin costs, not a bundled line that raises the fourth number. Retirement fees are a real part of what the quote omits.

What to confirm before signing

  1. Who is the plan sponsor per the documents?
  2. Who holds the fiduciary responsibility, and what stays with you?
  3. Are the contributions remitted at the correct schedule for the plan?

A PEO makes a 401(k) easier to run. It does not make it someone else's plan.

Frequently asked

Can a PEO sponsor my 401k?

No. The plan sponsor is the employer whose employees benefit. The PEO can administer recordkeeping and enrollment, but it does not take on the sponsor role or the core fiduciary duty.

Is a 401k through a PEO cheaper than standalone?

Sometimes, because the PEO aggregates participant volume. Compare the PEPM and the per-participant fee separately to know what you are really paying.

Does the PEO decide my match?

No. Matching is a plan design decision the sponsor makes. The PEO carries it out.
