Paid Holiday on Labor Day?
Private employers generally do not have to give Labor Day off or pay for it - federal law creates no private-sector holiday entitlement. A minority of states require holiday pay or premium rates in specific industries, which is where the exceptions live.
The general rule
Federal wage law sets no holidays. Whether Labor Day is paid time is a contract and policy question: exempt salaried staff typically receive it without deduction because the salary basis rules protect full-week pay; hourly staff receive it only if your policy grants it.
Where states differ
A small set of states mandate holiday observance or premium pay for defined groups - Rhode Island historically required premium pay for retail and certain commercial workers on holidays, and Massachusetts carries industry-specific rules. Healthcare, utilities and transportation carry their own regimes elsewhere. The pattern: requirements attach to industries, not to employers generally.
| Employment type | Labor Day pay |
|---|---|
| Exempt salaried, office closed | Full salary unaffected |
| Hourly, policy-granted holiday | Paid per policy |
| Hourly, no policy provision | Not required |
| Covered industry in specific states | Premium per state rule |
Write it down
Holiday disputes come from unwritten policies. State whether holidays are paid, whether working one earns extra pay or a floating day, and what happens when a holiday falls inside PTO. Multistate employers should check each state page - start at the state law index; see also how these rules shift year to year.

Frequently asked
Does working on Labor Day require overtime?
Not federally - holiday work earns straight time unless hours cross overtime thresholds or state/premium rules apply.
Can we require someone to work the holiday?
Absent a union agreement or specific state restriction, scheduling is the employer's call.
