Can a PEO Fire Your Employees?
No - a PEO cannot fire your employees. Direction and control of the workforce, including hiring and termination decisions, stays with you under every legitimate co-employment agreement. The PEO processes the paperwork; it does not hold the pen.
Who decides, who executes
Co-employment splits employer functions deliberately: you retain direction, performance management and the termination decision itself; the PEO executes final pay, benefits cutoff, unemployment response and recordkeeping. See the split table in co-employment explained.
That division is contractual, not decorative. Service agreements state that client retains responsibility for workplace decisions. A PEO that terminated staff over your objection would be breaching the agreement - and creating joint-employer liability for itself.
Where it can feel different
- Safety and compliance escalations. Risk teams can mandate actions (remove an unsafe worker from a job site pending investigation) without firing anyone.
- Benefit eligibility. Plan rules may end coverage on termination dates the PEO administers - timing you did not set.
- Mass events. In furloughs or layoffs, the PEO processes hundreds of changes but the list is yours.
Protecting the line of authority
- Read the responsibilities exhibit - termination authority should sit unambiguously with client.
- Route performance documentation through your managers, with the PEO advising.
- For any contested separation, sequence legal review before notice - the termination guide covers timing rules by state.
Handled this way, the question dissolves: the PEO is your HR back office, not your boss.

Frequently asked
Has a PEO ever refused to process a termination?
Rarely, and only on compliance grounds - e.g., suspected discriminatory reason. Even then they advise; you decide with counsel.
Does co-employment make the PEO jointly liable for wrongful termination?
Potentially, which is exactly why agreements preserve client control and indemnification terms matter - read them.
